Child Support Service - a service for people with child support problems

We are a specialist service which is part of Legal Aid NSW. We are not part of the Department of Human Services: Child Support (Child Support) or Centrelink. We can give you independent legal advice. Our service is completely confidential. We only provide information about you or your case to other people or organisations (like Child Support, DHS or Centrelink) with your permission.

Is this service for me?

We provide free advice and assistance to:

  • paying parents who have to pay financial support for children after separation;
  • carer parents who are or should be receiving financial support for children; and
  • people who are looking after children who are not their own because of an order of a Family Court or informal arrangement (for example grandparents, aunts or uncles of a child).

What sort of things can I get help with?

We can help you with things like proof of parentage, working out or changing child support assessments and agreements, Child Support decisions, Centrelink requirements about child support, over 18s maintenance, and court proceedings concerning child support legal issues.

In certain cases we can assist you to follow up your case with Child Support or by writing to the other parent.

We represent you in a tribunal or a court

In some circumstances, if you need further assistance, one of our lawyers can represent you in a Family Court or the Administrative Appeals Tribunal.

You will need to meet Legal Aid’s means, merit and policy guidelines to get a grant of legal aid. Our means test looks at how much money you earn and how much you own (such as money in the bank). Our merit test looks at whether your case is likely to succeed. A lawyer employed by Legal Aid NSW may not always be able to assist you because of ethical reasons. If this is the case, we will do our best to refer you to another lawyer who will be able to assist you.

If you are hearing or speech impaired, you can contact us by calling the National Relay Service (NRS) on 133 677 or TTY 9219 5126. The Translating and Interpreting Service provides free interpreters if you do not speak English. TIS can help you talk to services in your language. Call TIS on 131 450.
