CHILD AND FAMILY SINGLE EXPERT FEES IN ICL MATTERS

FOR ARRANGEMENTS MADE ON OR AFTER 1 JULY 2014 FOR PSYCHIATRISTS, CLINICAL

PSYCHOLOGISTS AND OTHER EXPERTS GST EXCLUSIVE

Single expert reports

Preparation of a report by a child and family psychiatrist or clinical psychologist on child/ren in any particular proceedings, including consultation with child/ren and parties, all standard reading time, liaison with other experts and relevant parties and preparation of the report

Additional reading time will only be allowed in exceptional circumstances and upon the prior approval of Legal Aid NSW at the rate of $250 per hour to a maximum of 5 hours

Updated reports
Where an updated report is ordered by the Court ($250 per hour up to a maximum of 6 hours)

Appearing in Court as an expert witness
Where required to attend Court as an expert witness including travelling and waiting time ($250 per hour to a maximum of 5 hours)

Refresher
Where an expert is required to give evidence in Court and the hearing is more than three months after the preparation of a report, the practitioner will be entitled to a refresher fee (only payable where the Court has not ordered an updated report)

Travel and accommodation expenses

Travel and accommodation expenses will only be paid upon prior approval of Legal Aid NSW. Travel expenses will only be paid where the round trip from the expert’s practice to court/consultation exceeds 70 km. Mileage will paid at the rate of $0.35 per kilometre. Where approved, accommodation expenses (including sustenance) will be paid as incurred but to a maximum of the NSW Public Service Travel Allowance.

 

Guidelines

  • Consideration will be given to the expertise of the proposed expert in determining whether approval should be given.
  • Fees in excess of the fee scale will only be approved in exceptional circumstances and will be the subject of negotiation with Legal Aid NSW, requiring the approval of the Director Grants or the Executive Director Family.
