FAP household scenario 3: couple with non-dependent children


Mindy and Pablo are married and live with their two children. Cleo is 24 years old and works part-time. Alijah is 25 years old and on a New Start allowance. Neither Cleo or Alijah pay rent to their parents. Mindy and Cleo have both been charged with an indictable offence. They make separate applications for legal aid.

This family consists of three separate households living under the same roof:

In Mindy’s application for legal aid, her husband Pablo will be considered a Financially Associated Person and his income and assets will be included in the Means Test. Cleo will be treated as a ‘single person’ household and does not have a FAP so only her own income and assets will be included in the Means Test.
