3.13. Contributions under section 36(1)(a)

13.1

In criminal indictable matters, indictable appeals and District Court severity appeals, exercising the discretion in the Means Test

  • To reduce it below the minimum contribution; or
  • to waive the initial contribution.

In defended Local Court criminal matters, where the total assessed contribution does not exceed $225 exercising the
discretion in the Means Test to waive or reduce the contribution.

In defended Local Court criminal matters, where the total assessed contribution is $225 or more, exercising the discretion in the Means Test to waive or reduce the contribution.

In relation to grants of legal aid in matters conducted by the Coronial Inquest Unit, the discretion to waive or decrease the initial contribution in matters where there is a public interest component in the granting of aid.
