Policy Bulletin 2019 / 11 (Extended Legal Assistance –State Parole)

The Legal Aid NSW Board has approved certain work in relation to State Parole and Serious Offender Review Council matters being provided under ELA.

Background
In July 2018, the Legal Aid NSW Board approved the implementation of a new Service Type, Extended Legal Assistance (ELA). ELA is an extended legal service which includes taking carriage of a matter (or multiple matters) in an ongoing, representative capacity, but due to the nature of the matter/s it does not proceed to a court or tribunal, or the lawyer is not required to appear before a court or tribunal. Where minor assistance was previously provided as multiple discrete services to one individual client, these are now recorded and counted as a “representation service”. The policies approved at that time were for family and civil law matters. ELA is provided only on an inhouse basis.

What has changed?
Certain work for State Parole and Serious Offender Review Council matters will be conducted as an ELA service. ELA funding is available subject to the applicant satisfying the ELA Means Test and the ELA Merit Test. The service is only provided by the inhouse practice.

Commencement date
ELA will be available to clients of the inhouse criminal law practice from 1 July 2019.
