Statement welcoming Standing Council of Attorneys General review of legal aid private lawyer model

Legal Aid NSW welcomes the decision of the Standing Council of Attorneys General (SCAG) to review the legal aid fees to private practitioners.

The review announced last week will provide an important overview of the sustainability of private practitioners doing legal aid work across NSW and nationally, providing key insights into access to justice, particularly in regional areas.

Legal Aid NSW CEO Monique Hitter said the review is the first step in ensuring we can continue to provide legal services to people eligible for legal aid in all parts of NSW.

“More than 70 per cent of legal aid work is done by private practitioners so without them our capacity to deliver representation services would be seriously impacted,” she said.

The announcement comes after a National Legal Aid survey of private practitioners found the supply of legal aid private lawyers is at unsustainably low levels, with many planning to leave.
