• reading court documents and other material
• drafting and preparing court documents
• one interim or procedural application listed for defended interim hearing
• all court appearances, and
• perusing and advising on any s 82 report.

Covers all work for the preparation of, or response to, any interim application, including:

• drafting and perusing court documents, related material, and
• taking instructions.

Note: This fee is only available if:

• the interim application is the second or subsequent interim application in a matter, and
• the interim application is contested and/or requires judicial determination.

Covers all work for the preparation for final hearing including:

• taking instructions, and
•  preparing court documents.

NOTE: to be eligible for this funding, the matter must be set down for a final hearing.

Leave application

Covers all work including:

• taking instructions
• preparing court documents. and
• attending court.

Leave granted

Covers all work from the granting of leave up to the conclusion of the directions hearing/mentions stage of the matter.

Note: leave must be granted to claim these fees.

$1560 (PP105)

Leave application

This covers all work including:

• taking instructions
• preparing court documents, and
• attending court.

Attendance at defended leave application, up to maximum of five (5) hours.

Leave granted

This covers all work up to the listing of any final hearing, including:

• taking instructions
• reviewing material, and
• preparing court documents.

Note: leave must be granted to claim this fee.

$195/hour (PP38)

This covers all work for the preparation for final hearing including:

• taking instructions, and
• preparing court documents.

Note: to be eligible for this funding, the matter must be set down for a final hearing.

Note: Legal Aid NSW may approve additional funding for final hearing preparation where it determines there are exceptional circumstances: see Care Fee Guideline 2

This covers all work including:

• taking instructions
• preparing court documents, and
• court appearances.

$195/hour (PP38)

This covers all work to the conclusion of the ECPO matter including:

• taking instructions
• preparing court documents, and
• court appearances.

Note: this fee cannot be claimed if the work was done on a duty basis.

$975 (PP113)

This covers all work up to any defended hearing including:

• taking instructions,
• perusing material
• preparing court documents, and
• court attendances.

$975 (PP114)

Attendance at dispute resolution conference, up to maximum of three (3) hours

$195/hour (PP38)

Appearance at hearing, up to five (5) hours per day

Note: A solicitor will only be paid solicitor advocate rate if Legal Aid NSW has approved briefing counsel: see Care Fee Guideline 4 

This covers all work for the preparation for final hearing including conferencing with the client

Note: Counsel can only be briefed in the Children’s Court where Legal Aid NSW determines the matter is complex (see Care Fee Guideline 3 )
