1.1 Availability of Funds Test

In most State matters legal aid will only be granted if Legal Aid NSW determines that sufficient funds are available.

This test applies to decisions made by the Legal Aid NSW Board that certain state matter types will not be funded for a specified period of time.

In Commonwealth matters Legal Aid NSW must consider available funds and competing priorities in determining applications for legal aid.
