4.14.1 Representation in the Administrative Review Tribunal

Legal aid is available for representation in the Administrative Review Tribunal (ART) for review of a reviewable decision under the National Disability Insurance Scheme Act 2013.

To be eligible for legal aid the applicant must satisfy:


4.14.2 Applications to the Guidance and Appeals Panel of the Administrative Review Tribunal

Legal aid is available for applications or referrals to the Guidance and Appeals Panel of the Administrative Review Tribunal in matters where there is an application for review of a reviewable decision under the National Disability Insurance Scheme Act 2013.

To be eligible for legal aid the applicant must satisfy:


4.14.3 Appeals from the Administrative Review Tribunal

Legal aid is available for an appeal from the Administrative Review Tribunal (ART) in relation to a reviewable decision under the National Disability Insurance Scheme Act 2013.

To be eligible for legal aid the applicant must satisfy:

  • the Means Test,
  • the Merit Test, and
  • Legal aid must be satisfied that in appealing from the decision of the ART:
    • there is a strong prospect of substantial benefit being gained by the applicant, and
    • the public interest would be significantly advanced if the applicant was represented.
