Family Dispute Resolution training module

This module provides private lawyers with an understanding of what happens before, during and after a mediation, how to prepare clients and the role of a lawyer in mediation.

Overview

This training module provides insight into how mediations are organised, how to prepare clients, the role of a lawyer in mediation and how best to support your client throughout the mediation process. It also details Legal Aid NSW Practice Standards and gives information and practical skills to use when you are representing clients at mediation.

Learning outcomes

By the end of the training, participants will:

  1. understand the role of a solicitor in supporting their client before, during and after a mediation and understand how the Family Dispute Resolution unit arranges and assesses the suitability of mediations
  2. demonstrate an understanding of the expectations of solicitors throughout the mediation process including applying for a grant of aid, information required to arrange a mediation, what to do when finalising a matter, the role of mediation reports and the issuing of certificates
  3. be equipped with the skills and techniques to ensure all families, including vulnerable and Aboriginal and Torres Strait Islander families, are provided with high-quality representation throughout the mediation process
  4. have more confidence in their understanding of the Legal Aid Family Dispute Resolution model, the different types of mediations available and the role of a mediator, and
  5. have knowledge of the Legal Aid NSW Practice Standards, and rules and expectations regarding confidentiality and admissibility.
